Terms of Service
Effective date: [Effective date]
In short: DeepEnd is a monthly or yearly subscription for pool service companies. Your company’s data is yours. You’re responsible for how you use DeepEnd with your own customers, including getting their OK for texts and call recording. AI suggestions are suggestions: a person at your company reviews them. Your ad spend is your own, and we can’t promise ad results.
1. These terms
These terms are an agreement between [DeepEnd legal business name] (“DeepEnd”, “we”) and the business that signs up for DeepEnd (“you”, “your company”). The person who signs up confirms they can agree for the business. Everyone your company adds to DeepEnd must follow these terms. Our Privacy Policy explains how we handle information.
2. The service
DeepEnd is software for running a pool service company: customers, routes, water readings, service reports, invoicing and payments, a business phone line, the Overseer assistant, a phone app for owners, office staff and techs, and optional connections such as Google Ads. We may improve, change or retire features over time; if we remove something important you pay for, we’ll tell you ahead of time.
3. Accounts
- Keep sign-in details private, and remove people from your team when they leave. You’re responsible for what happens under your company’s logins.
- The owner controls the company’s account, team, roles, billing and connections.
- Tell us right away at hello@godeepend.com if you think an account was misused.
4. Free trial, subscription and payment
- New companies may get a free trial. A card is required to start it. If you don’t cancel before the trial ends, your subscription starts and your card is charged.
- Subscriptions are billed monthly or yearly in advance through Stripe, at the prices shown when you sign up or change plans. Prices can depend on how many pools you service; changes in your pool count apply from your next bill.
- Taxes are added where required. Charges for phone use (calls and texts), if billed separately, are shown before you turn those features on.
- If a payment fails we’ll let you know and retry. If it still isn’t paid, we may pause your account until it is.
- You can cancel any time; service continues to the end of the period you paid for. Payments aren’t refunded except where the law requires.
- We’ll give at least 30 days’ notice before a price increase applies to you.
5. Your data
- Your company owns the information it puts into DeepEnd. You give us permission to store and process it only to provide DeepEnd to you, as described in the Privacy Policy.
- You can export your data while your account is open, and for 30 days after it closes by asking us. After that we delete it as the Privacy Policy describes.
- You’re responsible for having the right to put your customers’ information into DeepEnd and for keeping it accurate.
6. Your customers, texts and calls
When you use DeepEnd to contact your customers, you are the sender and you’re responsible for following the law. In particular:
- Only text people who have agreed to get texts from your business, honor STOP and other opt-out requests, and follow the texting rules of the phone carriers (DeepEnd registers your texting with the carriers on your behalf).
- Call recording: DeepEnd plays a recording notice to callers on your business line. Don’t turn recording on in ways that leave people unaware they’re being recorded; California and some other states require everyone’s consent.
- Follow the law for emails, invoices and collections you send through DeepEnd.
7. AI features
- DeepEnd’s AI (Overseer, call notes, text drafts, tips and the ad manager) can be wrong. Its output is a suggestion for you to review, not professional, legal, financial or chemical-safety advice.
- AI changes and messages go through your company’s approval settings. If you choose to let a kind of action run without approval, you accept responsibility for those actions.
- Pool chemistry numbers in DeepEnd are guides. Follow product labels and safety rules when handling chemicals.
8. Google Ads and other connected accounts
- Connecting Google Ads is optional. Your Google Ads account, its billing and its spend are yours, under your agreement with Google.
- DeepEnd changes your ads only when someone at your company approves the change, within the spend limits your owner sets, except a safety pause when a month is heading over your monthly limit.
- We don’t promise any ad results (calls, leads, customers or cost). We’re not responsible for what Google or Yelp charge you, for their outages or policy decisions, or for spend that happens before a change or pause takes effect at Google.
- You can disconnect at any time in Settings → Ads.
9. Acceptable use
Don’t use DeepEnd to:
- break the law, send spam or unwanted texts or calls, or mislead people;
- upload anything you don’t have the right to use, or malware;
- try to get into other companies’ data, get around security or limits, or overload the service;
- copy, resell or reverse-engineer DeepEnd, or build a competing product from it.
We may suspend accounts that do these things, with notice where reasonable.
10. Outside services
DeepEnd relies on providers such as Stripe, Twilio, Google, Apple and Anthropic. Payments you take are also governed by Stripe’s terms, and your phone numbers by Twilio’s and the carriers’ rules. We aren’t responsible for those providers’ own services.
11. Availability and support
We work to keep DeepEnd running and your data safe, but it’s provided “as is” and may sometimes be unavailable (for example during maintenance or a provider outage). The phone app keeps working offline for route work and syncs when it’s back online. Support is by email at hello@godeepend.com.
12. Disclaimers
To the extent the law allows, DeepEnd is provided without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement.
13. Limits of liability
To the extent the law allows: neither side is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or ad spend; and our total liability for any claim is limited to what your company paid DeepEnd in the 12 months before the claim. These limits don’t apply where the law doesn’t allow them.
14. Indemnity
Your company will cover claims against DeepEnd that come from your company’s data, your messages and calls to your customers, or your breaking these terms or the law.
15. Ending the agreement
- You can cancel any time in DeepEnd (Settings → Billing) or by emailing us.
- We can end or suspend service for serious or repeated breaches of these terms or unpaid bills, with notice where reasonable.
- When the agreement ends, access stops; you can ask for an export within 30 days (section 5). Sections that by nature should continue (like 12–16) do.
16. General
- These terms are governed by the laws of the State of California, and disputes go to its courts.
- We may update these terms. We’ll tell you about important changes at least 30 days ahead; using DeepEnd after they take effect means you accept them.
- If part of these terms can’t be enforced, the rest still applies. Not enforcing a part isn’t giving it up.
- These terms and the Privacy Policy are the whole agreement about DeepEnd unless we sign something else with you.
